The European Commission is preparing detailed rules on eligibility for orphan-medicine designation under the revised EU pharmaceutical legislation. At the Pharmaceutical Committee's meeting on 6 October, Member States urged a strict interpretation of 'significant benefit' and warned against widening the scope of orphan designation.

Under the existing framework, designation generally requires a condition affecting no more than five people in 10,000 in the EU. Where a satisfactory treatment is already authorised, the proposed medicine must offer significant benefit. The Commission's 2016 guidance explains how that additional benefit is assessed.

The reform retains these basic conditions but provides for two secondary measures. A priority implementing act will specify the designation criteria in greater detail. A separate delegated act may introduce different measures of rarity for particular conditions, including diseases with short duration and high mortality, where point prevalence can be misleading.

The Commission intends to draw on the 2016 guidance and the experience of the European Medicines Agency's Committee for Orphan Medicinal Products. Discussions also cover how to treat off-label use, individually prepared pharmacy medicines and the relationship with the new breakthrough orphan category. Member States have been invited to submit further comments, while the Commission and EMA continue technical work. Neither measure has yet been adopted.

The eventual rules will help determine which products qualify for orphan designation and, following authorisation, the associated commercial incentives. The October discussion indicates a preference for retaining the existing demanding benefit test, while leaving the treatment of particular comparators and rarity assessments to further rulemaking.
