Switzerland's planned medicines-pricing reforms face a further implementation delay after the Council of States Social Security and Health Committee (Kommission für soziale Sicherheit und Gesundheit des Ständerates, SGK-S) unanimously recommended postponing adoption of most implementing ordinances under Cost-Containment Package 2.

The decision strengthens the case for delay raised by the National Council committee in August, but differs on the scale of revision required. SGK-N had called for the ordinance package to be fundamentally rewritten in response to the changed international pricing environment. SGK-S says the legislation adopted by Parliament should remain the framework and sees no need for such a comprehensive redesign.

Instead, it wants the draft ordinances revised after the government's Life Sciences Location working group reports at the end of 2026. The review should consider consultation responses and aim to preserve access to innovative medicines without materially increasing health-insurance premiums. Pharmaceutical companies and insurers should participate in the revision.

The affected package includes volume rebates for high-turnover medicines, price models, provisional 'day-zero' reimbursement and wider changes to medicine price-setting. The original implementation timetable envisaged the ordinances taking effect from the beginning of 2027. Waiting for the year-end report, subsequent redrafting and renewed committee scrutiny now puts that timetable in doubt.

SGK-S wants work to continue separately on differentiated effectiveness, appropriateness and cost-effectiveness assessment for generics and other low-cost medicines, where the objective is to reduce economically driven supply withdrawals.

Revised ordinances will return to SGK-S after further administrative analysis. The committee will then also consider motions addressing access to innovative medicines and the effects of US pricing policy before the Federal Council proceeds with final implementation.
